What Is a DMCA Takedown?

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that provides a process for copyright holders to request removal of infringing content hosted by online service providers. While VentureHelm is a Canadian company, we honour DMCA notices in addition to the Canadian notice-and-notice regime under the Copyright Modernization Act (2012).

How to Submit a Takedown Notice

Send your DMCA takedown notice to:

Your notice must include:

1. Identification of the copyrighted work you believe has been infringed.
2. Identification of the material you believe is infringing, including the URL where it appears.
3. Your full contact information (name, address, phone number, email).
4. A good faith statement that the use of the material is not authorized by the copyright owner, its agent, or the law.
5. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
6. Your physical or electronic signature.

Counter-Notice Rights

If you believe your content was removed in error, you may submit a counter-notice. It must include:

• Identification of the removed content and the location where it appeared.
• A statement under penalty of perjury that you believe in good faith the material was removed by mistake.
• Your name, address, and phone number, along with consent to the jurisdiction of the applicable federal court.
• Your physical or electronic signature.

Repeat Infringer Policy

VentureHelm reserves the right to suspend or terminate accounts of users who repeatedly infringe the copyrights of others, in accordance with our repeat infringer policy.

Canadian Notice-and-Notice Regime

As a Canadian company, VentureHelm also complies with the notice-and-notice regime under the Copyright Modernization Act (2012). When we receive a copyright infringement notice, we forward it to the site owner within 5 business days and retain the notice for 6 months as required by law.
